Sphere Entertainments
Terms & Conditions of Business
1. Booking & Reservation Fee A booking is confirmed once a signed agreement and reservation fee have been received. The reservation fee secures the event date and covers administration and loss of potential bookings. The reservation fee is non-refundable and non-transferable, except in the event that Sphere Entertainments cancels the booking. Sphere Entertainments reserves the right to withdraw any provisional booking if the signed agreement and reservation fee have not been received by the due date stated in the agreement.
2. Rescheduling Requests to reschedule an event must be made in writing and are subject to availability. Where Sphere Entertainments is available on the proposed new date, the booking may be transferred and any monies paid will be applied to the new date. If the new event date attracts a higher fee than the original booking, the client will be responsible for paying the difference. This includes, but is not limited to, changes from weekday to weekend dates, off-peak to peak season dates, venue changes, package upgrades, or any other circumstances that increase the applicable fee. Where a booking is rescheduled to a date more than 16 weeks after the original event date, Sphere Entertainments reserves the right to recalculate the booking using its current pricing structure. Any increase in fees resulting from revised pricing, package changes, venue requirements, or price increases introduced since the original booking will be payable by the client. Only one reschedule request will be permitted under this clause. Any subsequent request to change the event date will be at the sole discretion of Sphere Entertainments and may be treated as a cancellation by the client. If Sphere Entertainments is unavailable on the proposed new date, the request will be treated as a cancellation by the client and the cancellation terms set out in this agreement will apply.
3. Balance Payment The remaining balance must be paid by the date stated in the agreement. Bookings made within 28 days of the event require full payment at the time of booking. Failure to pay the balance by the due date will be treated as a cancellation by the client and the cancellation terms below will apply.
4. Cancellation Policy All cancellations must be confirmed in writing. Clients may cancel within 14 days of signing the agreement and receive a full refund of monies paid, unless the event is scheduled to take place within this period. This does not apply to rescheduled events, which remain bound by the original agreement date. If cancellation occurs more than 16 weeks (112 days) before the event, the reservation fee will be retained. If cancellation occurs within 16 weeks (112 days) of the event, the full remaining balance will become immediately due and payable, as Sphere Entertainments will have reserved the event date and may be unable to secure an alternative booking at short notice. Failure to pay the balance by the agreed payment date will be treated as a cancellation by the client, and the above cancellation terms will apply. The cancellation terms apply regardless of the reason for cancellation, including but not limited to changes in personal circumstances, relationship changes, venue changes, or event cancellation by the client.
5. Venue, Access & Setup The client must ensure suitable access to the venue and allow adequate time for setup before the event and removal of equipment afterwards. Any access restrictions must be communicated in advance.
6. Power & Equipment Requirements A safe and reliable mains power supply must be available within 10 metres of the performance area. Sphere Entertainments reserves the right to refuse connection to unsafe power supplies or unsuitable generators and cannot be held responsible for power failures beyond its control.
7. Outdoor Events Outdoor events (including marquees) must be confirmed at the time of booking. Suitable shelter must be provided to fully protect equipment from weather conditions.
8. Venue Restrictions Sphere Entertainments will comply with all venue rules and sound restrictions, including the use of sound limiters where present. The client is responsible for ensuring that the venue permits the performance. If the venue requires reduced sound levels, restricts performance times, or stops the music due to venue policies or sound limiter activation, Sphere Entertainments cannot be held responsible and no refund or reduction in fee will be given.
9. Safety & Liability The client is responsible for the conduct of their guests. Abusive or threatening behaviour towards Sphere Entertainments staff will result in the performance being stopped immediately. All equipment provided by Sphere Entertainments remains the property of Sphere Entertainments and must not be handled or tampered with by guests or venue staff. Any loss of or damage to equipment caused by the client or their guests may result in repair, replacement or recovery costs being charged to the client. Sphere Entertainments accepts no responsibility for equipment failure, interruption of service, or damage resulting from interference, misuse, or unauthorised handling of equipment by guests, venue staff, contractors, or any third party.
10. Unforeseen Circumstances Sphere Entertainments will make every effort to provide the booked DJ/service. If a DJ cannot attend due to illness or unforeseen circumstances, Sphere Entertainments will make reasonable efforts to provide a suitable replacement. If this is not possible, a full refund will be issued. Sphere Entertainments cannot be held liable for failure to perform where circumstances beyond reasonable control prevent the event from taking place, including but not limited to severe weather, venue closure, power failure, or government restrictions.
11. Photography & Media Photos or video footage taken by Sphere Entertainments or its representatives may be used for promotional purposes, including on the Sphere Entertainments website, social media channels, marketing materials and other advertising platforms, unless the client requests otherwise. Clients may request that photographs or video footage from their event are not used for promotional purposes by notifying Sphere Entertainments in writing prior to the event.
